Edi Rama discharged Mayor Zef Hila without a government’s meeting, Constitutional Court nullifies the decision

The Albanian Constitutional Court has nullified the Government’s decision for the discharge of Mayor of Vau i Dejës, Zef Hila.

The Constitutional Court argued that the decision for Hila’s discharge was taken in a hurry and he was left no time to express his claims.

Furthermore, the Albanian daily Panorma reports the government could not offer evidence of a meeting of the Council of the Ministers to decide on Hila’s discharge.

“The Courts notes that Article 14 of Law no. 9000/2003 allows extraordinary meetings of the Copuncil of the Ministers in special cases, when summoned by the Prime Minister, or – in his absence and per his order – by the deputy Prime Minister. Despite the Court’s request, the interest subject did not offer evidence and documents to prove the call of that meeting, its agenda, place of meeting and the participants, claiming that the acts that contain these data exist but cannot be presented to the court because they are protected by the confidentiality”, the Constitutional Court said in its ruling.
