Tirana Court fully accepts Mr. Meta’s Appeal against the Prosecution’s decision to not start investigations against the Members of the Authority of Files.

The court has proved that the Prosecution decision was fully illegal in content, as well as in the procedural aspects of the Albanian legislation, for a due legal process.

Even before Mr. Meta had considered the decision of the Prosecution as Null and Void, whilst this latest development from the Tirana Court, confirms in full the position of Mr. Meta, by obligating the Prosecution to register the criminal proceedings and start in depth investigations for the Authority of Files, and its Members.

The Court with its decision given on 18.11.2022, considered the Prosecution decision as illegal, fully abolished it, and also assigned the Prosecution the legal obligatory tasks, to register the case and make detailed investigations, as clearly described in the court’s decision.

 First, the prosecution has to register the criminal proceeding, and make investigative actions in clarifying the data presented in the Criminal charges pressed by Mr. Meta.

Secondly, the prosecution was obligated by the Court to perform the following investigations:

1. To call and question the citizen Filip Talo, about his relation and his name with the State Security institutions until the end of 1990, for the facts and events of that time, as well as his own claims about the people which has denounced him at the State Security.

2. Demands a full investigation for the acts of the employees of the Authority of Files, from the moment they have received the anonymous email, and everything they have done afterwards, and more specifically:

a. Every communication, via letter of electronically between the Members of the Board.

b. All Proces-verbal of the Board of the Authority, and the decisions taken for this case.

c. All communication, information, report, of the Authority of Files with the High Level Public Institutions in Albania, such as the Albanian Parliament.

d. All Proces-verbal of the withdrawal of the File of the subject Filip Talo.

e. The Registry of the people entering and exiting from the Archives Fund of the Authority.

f. The Registry of documentation usage.

3. To be taken in question by the prosecution, as people that have knowledge on the circumstances of inquiry, the following persons: Mrs. Gentiana Sula, Mr. Albert Nikolla, Mr. Altin Hoxha, Mr. Gjergj Marku, Mr. Skënder Vrioni, as well as any other person working at the Authority of Files, involved with this case.
