Albanian Helsinki Committee, in the capacity of one of the official monitoring bodies of the Judicial Reform has reported none of the judges and prosecutors dismissed by the vetting process for not being able to justify their assets has been under investigation by the Prosecution Office.

“Based on the code of the criminal proceedings, when the administrative organs, such as the Independent Committee of Qualification (KPK), during the investigation, find facts or circumstances that pose a criminal offence, they have the obligation to declare their findings to the prosecution. So far, there is only one case when KPK has sent the file of a dismissed person to the Prosecution Office but the later has decided not to investigate”, said AHC director Erinda Skëndaj.

Fifteen judges and prosecutors have been dismissed so far but the Prosecution has started investigation only for the case of former judge Admir Thanza, even though it is an investigation over fake declarations in the applications, not over hiding assets.
